Do I really need a lawyer?
Absolutely. Insurance companies are in business to make money, and you need the best lawyer to represent you and fight for you. It’s one thing for a consumer to haggle over the price of a used car as you likely have some feel for that, but there’s a long learning curve to knowing the fair value of an injury claim. It’s also crucial that you be aware of the many pitfalls that lie in wait for the unrepresented, including such things as statutes of limitations and legal notification requirements. Besides you not being familiar with value, at the outset of a claim the insurance company will frequently look for a reason to deny your claim involving various liability defenses and insurance policy exclusions. This is why we advise our clients to always let us do all the talking.
When should I call a lawyer?
As soon as possible. There is often important investigation which we do at the outset of a claim which can make the difference between winning and losing. We provide valuable guidance and advice at the outset to optimize our client’s successful recovery. You need someone on your side from the very beginning, because even as you begin to recover, the other party’s insurance company will start an investigation. It has been our experience that insurance companies cannot be expected to deal fairly with you, even in what appears to be a clear-cut case. The bottom line is that you should expect an insurance company to try to pay little or nothing, and in some cases to place the blame upon you. This is easily achieved against an uninformed or poorly represented claimant.
How should I choose a lawyer?
You want a lawyer who has deep experience in personal injury, who takes a creative approach to fighting for your rights, and who shows a sincere compassion for your situation. Our firm typically receives the customary one-third of a settlement or award only after a claim is successfully resolved and the client receives his or her money.
