According to the most recent statistics available from the Massachusetts state government, rideshare companies – also called transportation network companies – provided 91.1 million rides in Massachusetts in 2019, approximately 12.0% more than in 2018 and 40.6% more than in 2017. What happens if you are a passenger in an Uber or Lyft vehicle that is involved in a car accident?

In general, you are covered by the insurance that Uber and Lyft provide to insure their drivers.  According to Uber’s website, it maintains a $1 million liability insurance policy that covers all of its drivers, from the moment a driver accepts a trip until the time the trip is over and the passenger exits the vehicle. Lyft’s website says the same — $1 million in liability insurance coverage.  This is better insurance than most individual drivers carry. It is also much better insurance than what most taxi drivers carry.

What if you are in your own vehicle and get in an accident with an Uber or Lyft Driver?

This gets a little more complicated.  If there is a passenger in the Uber or Lyft vehicle, or if the driver is on the way to pick one up, there is still plenty of insurance. Uber’s or Lyft’s $1 million policy should cover any claims for injuries or damage to your car.  But if the driver is logged into the Uber or Lyft app and waiting for his next call, the companies provide only $50,000 in liability coverage, and that is all there is, because the driver’s personal auto policy will not cover that driver at all. What to do after a car accident:

What is the deadline for filing a lawsuit relating to a car accident?
