Truck Accident Attorneys

Being involved in a crash with a large truck is an overwhelming and frightening experience. Such crashes occur far too often.  According to reports by the Federal Motor Carrier Safety Administration, there were 5,340 fatal motor vehicle crashes in 2021 that involved at least one large truck or bus, another 531,000 non-fatal crashes that involved at least one large truck or bus.  The injuries and damage caused in a crash involving a large truck like a tractor trailer is usually far greater than a crash with a passenger vehicle because of the size and weight of the tractor trailer.

If you or someone you know has been injured in a truck accident, hiring an experienced Massachusetts trucking accident lawyer is the only way to pursue full and fair compensation under the law. An experienced truck accident lawyer can help you recover your past and future lost wages, your medical expenses, and other damages linked to an accident caused by a negligent truck driver or trucking company.

Trucking accidents can be caused by a variety of different factors but many of these have to do with the negligence of the truck driver or negligence of the company that hired the truck driver. For example, accidents can be caused by:

  • Overloaded trucks
  • Drug or alcohol use
  • Failure to adhere to federal laws and regulations for truck driving
  • Excessive hours
  • Driver fatigue
  • Distracted driving
  • Reckless and aggressive driving
  • Jackknife accidents caused by driver’s loss of control
  • Dangerous lane changes
  • Rollover Accidents

Because tractor trailers are so large and dangerous, the Federal Motor Carrier Safety Administration (FMCSA) has instituted strict regulations for these trucks and their operators.  The FMCSA regulates the amount of hours and consecutive hours a tractor trailer driver can drive during a day and week. The FMCSA also mandates that truck owners perform regular maintenance checks on their vehicles and make any necessary repairs. These regulations are meant to make the roads we share with large trucks safer.

Unfortunately, many trucking companies don’t follow these rules and encourage their drivers to skirt regulations in order to increase profits.  Our attorneys and the experts we hire are well-versed in the FMCSA regulations, and are prepared to hold truckdrivers and trucking companies accountable for any crashes caused by failure to follow all of the FMCSA regulations.

  • Interstate 95
  • Interstate 93
  • Route 1 on the North Shore
What is the deadline for filing a lawsuit relating to a truck accident?

All lawsuits for injuries caused by trucking accidents must be filed in court within three years of the date of the incident.  However, it is always best to get an experienced injury lawyer involved in your case as soon as possible after a trucking injury.  Important evidence, such as evidence recorded by the truck’s dashboard cameras or the truck’s “black box”, or event data recorder, can be lost if an investigation of the accident is delayed.

What if the accident was partially my fault?

Sometimes people blame themselves for any traffic accident.  These feelings are perfectly natural and understandable, but you can still recover from a careless or negligent person who also partially caused your injuries.  An injured person may recover as long as he or she is not found to be more at fault than the other persons who caused the injury.  In other words, if the injured person and another person are equally at fault, the injured person can still recover, but their recovery is reduced by their own percentage of fault.  So, if a jury decides the injured person was 25% at fault, that person’s recovery is reduced by 25%.  So it still makes sense to pursue compensation from a truck accident, even if you feel that you were partially at fault.

Attorney For police Officers In Massachusetts

Our goal is to collect as much money as possible for Massachusetts police officers and State Troopers injured while on duty and minimize the financial impact on their families. We also make it a point to ease tensions between the client and the department, if any, and to help the employee return to full duty as quickly as possible. At times, we connect injured officers with respected medical specialists to treat their injuries.

Some officers are of the opinion that they can’t make a claim against a responsible third party who causes their injury. This is not the case. In Massachusetts, it is the right of every individual, no matter what his or her occupation, to be compensated for an injury caused by another. We believe this should and must apply to public safety employees hurt on duty. And that is what the law provides. To learn more about your rights, the law and how these claims are made, view our free recorded webinar: Police Injured On Duty: Learn Your Rights To Make Personal Injury Claims.
